Agreement & Waiver

Rules and Regulations:

By tendering this application, the person whose name and signature appears on this document, agree to abide by all rules and regulations of TnT Nitro Fitness LTD, including but not limited to the following:

- All membership dues must be paid in full including all terms of payment plans prior to cancellation

- All members are required to key in upon arrival to the club.

- There will be a $30 fee for any payment returned to TnT Nitro Fitness LTD.

- Proper indoor footwear must be worn.

- All weights are to be put away in their proper, location after use.

- Please respect our equipment and facility.  Any damage to the Club or equipment by the member will be   charged to the member.    

- TnT Nitro Fitness reserves the right to cancel membership at any time for any reason. 

WAIVER, RELEASE & INDEMNITY

In consideration of TnT Nitro Fitness LTD providing me with the services set out in this contract, I hereby agree to the following conditions.

1. I WAIVE any and all claims which I may now or in the future have against TnT Nitro Fitness LTD, their directors, officers employees,  contractors and agents as well as any other person who may provide services to the Club on whose behalf this agreement is also made (collectively referred to herein as “the Club” howsoever arising from or in any way connected to my use of, attendance at or participation in, any of the Club’s Facilities, including the parking facilities, or services or programs whether or not on or in any of the Club’s premises;

2. I RELEASE the Club from any loss, damage, injury, or expense which I may suffer or incur as a result   in any way of my use or attendance at the Club, including the parking facilities, or my participation in any of the services or programs provided by the Club, whether or not on or in any of the Club’s premises, from any cause whatsoever;

3. I INDEMNIFY AND HOLD HARMLESS the Club from any and all claims, actions, suits, judgments, and other legal obligations and liabilities which result, or are alleged to result, from my or my child’s (children’s) relationship with the Club and I ACKNOWLEDGE that this WAIVER, RELEASE AND INDEMNITY IS FINAL AND   BINDING  upon myself or my child(ren) and in the event of my death or my child’s (children’s) my HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS AND ASSIGNS.

4. Buyer represents that he/she is in good physical condition and the buyer has no disability or impairment preventing the buyer from engaging in active or passive exercise that would be detrimental to the Buyer’s health, safety or physical condition.

24 Hour Access Waiver

You have agreed to purchase a membership at TNT NITRO FITNESS LTD in Quesnel that allows you access at any time. As such, you are aware that there will be no supervision or assistance. You are also aware that if you are injured, become unconscious, suffer a stroke or heart attack, that there will likely be no one to respond to your emergency and this facility has no duty to provide assistance to you. Even though TNT NITRO FITNESS LTD is equipped with surveillance cameras, it is likely that should you require immediate assistance, none will be provided. We HIGHLY recommend that you have a workout partner accompany you while at TNT NITRO FITNESS LTD, but it is entirely up to you. 

Because physical exercise can be strenuous and subject to risk of serious injury, TNT NITRO FITNESS LTD urges you to obtain a physical examination from a doctor before using any exercise equipment or participating in any exercise activity. You (the member) agree that if you engage in any physical exercise or activity, or use any TNT NITRO FITNESS LTD amenity on the premises, you do so entirely at your own risk. You agree that you are voluntarily participating in the use of this facility and assume all risks of injury, illness, or death. We are also not responsible for any loss of your personal property.                 

Under no circumstance may a member bring an unauthorized guest into the facility during non staffed hours. Violators will have their memberships terminated and under no circumstance will any money for the membership be refunded. 

Non-payment of any charge constitutes a default in the agreement. If monthly account payment is not received within 10 days of its due date, member’s 24 hour access will be disrupted.

This waiver and release of liability includes, without limitation, all injuries which may occur, regardless of negligence, as a result of; (a) your use of all amenities and equipment in the facility and your participation in any activity, class, program, personal training or instruction, (b) the sudden and unforeseen malfunctioning of any equipment, (c) any dietary recommendations and (d) your slipping and/or falling while in TNT NITRO FITNESS LTD premises, including adjacent sidewalks and parking areas.             

You acknowledge that you have carefully read this “waiver and release” and fully understand that it is a release of liability. You expressly agree to release and discharge TNT NITRO FITNESS LTD, and all affiliates, employees, agents, representatives, successors, or assigns, from any and all claims or causes of action. You agree to voluntarily give up or waive any right that you may otherwise have to bring a legal action against TNT NITRO FITNESS LTD for negligence, personal injury or property damage.

Do not drop freeweights. Rack all weights after each use.   

Note; should any part of this agreement be found by a court of law to be against public policy or in violation of any provincial statue or case precedence, then only that wording is removed and the remainder of this agreement will remain in full force.
